By consenting to this agreement, you acknowledge you have read and accepted these Terms & Conditions, and you agree to conduct transactions with Russian River Getaways (RRG) electronically. You acknowledge that you have received and will abide by the following rules and policies set forth by RRG, along with those found on the RRG website (https://www.russianrivergetaways.com/before-you-book), the house listing, and at the house. This agreement may be referenced under “Terms and Conditions” on the RRG website. Please print and retain a copy for your records.
OCCUPANCY: You will personally occupy the home for the entirety of the reservation. You are responsible for notifying other occupants of the contents of this agreement and for charges incurred by other occupants.
GOOD NEIGHBOR POLICIES: Quiet hours are 10pm-7am (neighbors should not hear you during that time). No outdoor amplified sound/music (e.g., outdoor speakers) at any time. No guests or cars in excess of the maximum occupancy and cars noted in house listing. No weddings, parties, events, or loud gatherings of any kind. No temporary structures (including tents) or RV’s. No unsecured dogs or nuisance barking. Dogs left alone will be crated indoors. No firepit (where applicable; check listing) use during fire season. When allowed, firepits will be extinguished when unattended and after 10pm. State/local fire bans will be observed. You agree to honor the terms of these good neighbor policies and Sonoma County’s Vacation Rental Ordinance. Egregious or repeat violation of any of our good neighbor policies or the County Ordinance may result in a $1000 penalty and/or termination of your reservation. Refusal to vacate the property upon completion or termination of your reservation also carries a $1000 penalty.
PROPERTY EXPECTATIONS: It is your responsibility to read the house listing, ask questions, and make sure you’ve booked the right home for your needs. You agree to check the home upon arrival and notify us of any property-related issue immediately, and to leave the property in the condition in which you found it. No cats allowed. No commercial use of the property. No smoking or vaping of any kind is allowed ($500 penalty for violation).
TERMS OF PAYMENT: You agree that we may charge your credit card for any amount due upon booking within 24 hours of your signing this agreement.
CANCELLATION:
-Full refund for cancellations up to 30 days before check-in. If booked between 30 and 14 days before check-in, 50% refund up to 7 days before check-in. No refund after that.
-Cancellation requests must be made in writing to bookings@rrgetaways.com. There is no partial refund for early departure. RRG cannot refund 3rd party service fees or taxes under any circumstances.
-Extenuating Circumstance: If our ability to host you is restricted or substantially limited by an extenuating circumstance, such as a government-mandated health or evacuation order, or a home becomes unexpectedly unavailable, RRG reserves the right to terminate your reservation and refund your payment. If this occurs once your stay has commenced, RRG reserves the right to terminate the remainder of your reservation and require that you vacate the property. RRG will refund your reservation payment on a pro-rata basis, less any applicable cleaning charges or any extra charges that you may incur under the terms of this Agreement. Refusal to vacate the property upon termination of your reservation carries a $1000 penalty. You understand and agree that RRG is not responsible for any collateral loss you may suffer due to the termination of your reservation, whether the reservation is terminated before or during your occupancy. Such collateral loss may include, but is not limited to, travel expenses, lost reservations, loss of income, or medical expenses.
RIGHT TO ENTER PROPERTY: We reserve the right to enter the property and document findings, if we believe this agreement has been violated, as well as for necessary repairs and maintenance.
EXTRA CHARGES: By entering into this agreement, you agree we may charge your credit card on file for any fees, charges, penalties, repairs and estimates for repairs assessed under the terms of this agreement, including, but not limited to, accidental damage in excess of $1000, intentional damage or loss (including intentional acts likely to cause damage or loss even if damage or loss was not intended), extra cleaning (including fouling hot tub water to the point the maintenance company determines the tub must be drained & refilled) and/or excess trash removal, and damage or loss due to violation of these terms and conditions.
RELEASE OF LIABILITY: You as the guest fully release and discharge the owner of the vacation rental, Russian River Getaways, and our agents from any claim, demands and causes of action by reason of any injury or loss suffered by you and/or any member of your party in connection with the occupancy of the vacation rental, and you agree to hold the owner of the vacation rental and Russian River Getaways free and harmless of any claim or suit arising from the occupancy. In any action concerning the rights, liabilities, or duties of the parties to this agreement, the prevailing party shall be entitled to reasonable attorney fees and costs. Russian River Getaways is not responsible for losses due to theft, fire, vandalism or intentional acts of any third party.
Spas, Hot Tubs, Swimming Pools (where applicable; check listing)
All guests use swimming pools and hot tubs at their own risk. By entering into this agreement, you agree to hold Russian River Getaways, its owners and employees, and owners of your vacation home harmless and to indemnify them for any injury, loss, claim or damage resulting from the use of the hot tub and swimming pool located at the vacation home by you and any members of your party. The use of hot tub and swimming pool entails certain significant risks of serious harm, including death and great bodily injury, which you will need to explain to members of your party, and you are expressly assuming all risk for yourself and all members of your party. You agree to supervise children at all times around the hot tub and swimming pool and to keep children six years of age or younger out of the hot tub entirely. You further agree that no one pregnant, intoxicated, or who has a heart condition or other health problem that might create a further risk of harm will use the hot tub or swimming pool during the rental. You expressly agree to review and adhere to any Hot Tub and/or Swimming Pool Rules provided at the house.
Boating Equipment (where applicable; check listing)
All guests use boating equipment, including docks, at their own risk. By entering into this agreement, you agree to hold Russian River Getaways, its owners and employees, and the owners of your vacation home harmless and to indemnify them for any injury, loss, claim or damage resulting from the use of any boating equipment located at the vacation home by you and any members of your party. You also agree that all members of your party will use life jackets, provided by you if not available on the premises, while using any such boating equipment. The use of boating equipment entails certain significant risks of serious harm, including death and great bodily injury, which you will need to explain to members of your party, and you are expressly assuming all risk for yourself and all members of your party. In particular, you agree to ensure that no one stands up in any boat at any time and that no one will consume alcohol or any other intoxicating substance while using the boating equipment.
You agree that Russian River Getaways is not liable for any collateral expenses, including, but not limited to, travel expenses, lost reservations, loss of income, or emotional harm from the unavailability of a home due to circumstances beyond our control.
COVID-19 NOTICE: You agree and acknowledge that the situation regarding COVID-19 may negatively impact your reservation. You also agree and acknowledge that the terms of a Federal, State, and/or County issued shelter-in-place or other health order may be applied to your reservation dates, even if those terms did not exist when you booked. You agree to abide by the terms of any Federal, State, and/or County issued shelter-in-place or other health order, including social distancing rules or guidelines, that are applicable to your reservation dates while you are occupying the property.
You understand and agree to indemnify and hold harmless RRG to the fullest extend allowed under the laws of the State of California, from any and all loss and damage including, but not limited to, medical, hospital, and health care related costs of any kind, that you, your family or guests, or any pets, may incur from contracting COVID-19 before, during, or after your occupancy of the property. With regards to COVID-19 and your occupancy of the property, you assume every and all risk of loss to the greatest extent allowed under the laws of the State of California.
INVALID CLAUSES: If any clause or provision of this Agreement shall be held invalid or void for any reason, such invalid or void clause shall not affect the remaining clauses or provisions and the remaining clauses and provisions shall remain in full force and effect.
GOVERNING LAW: This agreement shall be governed by and construed in accordance with the laws of the State of California.
CHANGES TO AGREEMENT: No modification, amendment, release, discharge or waiver or any provisions hereof shall be of any force, effect or value unless in writing, signed by both parties.
By signing this agreement, either in ink or electronically, you acknowledge that you have reviewed the rules and policies of this agreement, that you understand them, and that you agree to abide by them.
You must be 21 years old to sign this agreement.
